Terms and conditions

These are the conditions under which Unique Colombia S.A.S offers its website and provides its travel-agency and lodging services. Using the site or booking a service means accepting them.

Who we are

Unique Colombia S.A.S, tax ID 900463801-4, registered at km 62.5 on the Santa Marta – Palomino road, Sierra Nevada de Santa Marta, Magdalena, Colombia.

We hold two separate entries in Colombia's National Tourism Registry, because we provide two kinds of service: RNT 25776 as a travel agency, and RNT 30345 as tourist lodging — Finca La Jorará, rural accommodation.

As a tourism service provider we are subject to Law 300 of 1996 and its amendments, and to Decree 1074 of 2015.

Acceptance and legal capacity

Using this site or booking any of our services means accepting these Terms and Conditions, as well as the Personal data policy.

Only people with legal capacity to contract may do so. Minors cannot book directly: they travel and stay under the responsibility of an adult who books and answers for them.

What we offer

Through uniquecolombia.co we offer two kinds of service, and it is worth telling them apart because it changes who answers for what.

The La Jorará lodging is provided directly by us. We are the operator, not an intermediary, and we answer for the quality and provision of the accommodation.

Experiences and tour packages are, depending on the case, operated by us or sold by us as a travel agency intermediating a third-party operator. When we act as intermediaries, we answer for the accuracy of the information we publish and for handling your booking, but the service itself — the itinerary, the transport, the activity — is the responsibility of the operator carrying it out, under article 2.2.4.3.2.4 of Decree 1074 of 2015.

Staying at La Jorará

Check-in is at 2:00 p.m. and check-out at 12:00 noon. If you need a different time, write to us before you arrive and we will see what is possible depending on availability.

The La Jorará units are booked with live availability through the booking engine shown on the site. The rest of the stay's conditions — number of guests, pets, each unit's own policies — are described on that unit's page.

How to book and pay

The La Jorará units are booked online, with live availability. The rest of the portfolio and all experiences are confirmed over WhatsApp or email: we send you the availability and the price, and you confirm once you agree.

Payments are made by bank transfer, to Bancolombia savings account number 51774570814, held by Unique Colombia S.A.S, tax ID 900463801-4; or through Bold. Before asking you for a payment, we confirm the amount, the service and the method in writing.

Generally a 30% deposit of the total value is paid to confirm the booking, and the balance must be settled at least 8 days before the service begins, unless it starts sooner, in which case it is paid in full before it begins. Where the service allows it, the full 100% can also be paid upfront.

Paying the deposit does not guarantee a spot on services subject to availability: we confirm that in writing. If there is no availability for the chosen date, we reschedule the service or refund what was paid.

What the price includes

The price covers only what is explicitly described on the service's page on the site. It does not include personal expenses, traffic fines, rental of equipment not mentioned, or consumption such as drinks, food, hairstyling, massages or beauty services that are not explicitly listed.

If you need to cancel or change your booking

You have up to 72 hours after booking to cancel with no cost beyond any bank or administrative fees already incurred.

Cancelling less than 24 hours before the service starts carries a penalty of between 30% and 100% of the value, depending on the service.

When a service depends on a minimum number of participants and that minimum is not reached 8 days before the date, we may cancel it. In that case we refund 100% of what was paid, or offer to split the shortfall among the participants so the plan goes ahead anyway, or reschedule it.

Because of force majeure, public-health situations, weather, the closure of parks or nature reserves, or other factors outside our control, we may change or cancel a service before or during the trip. If that happens, the new conditions keep the same standard originally offered.

If you do not show up

If you booked a service and do not show up at the agreed time, without letting us know, we may charge 100% of the value.

Refunds

Where a refund is due, we make it within 30 calendar days of having all the information needed to process the transfer — the cancellation confirmed and the bank details to send it to.

The refund is made to a bank account in Colombia. Transfer costs and Colombia's financial-transactions tax (4×1000) are borne by whoever receives the refund.

Right of withdrawal

Under article 47 of Law 1480 of 2011, you have the right to withdraw from the purchase within five (5) business days of making it.

You cannot exercise it once the service has started with your consent, or if fewer than five days remain before the service is due to begin.

If you withdraw in time, we refund everything paid, with no deduction, within the following 30 calendar days. To exercise it, write to the email in the footer of this page.

Electronic payment reversal

If you paid by credit card, debit card or another electronic payment instrument, you have the right to have the payment reversed, under article 51 of Law 1480 of 2011, when: you were the victim of fraud; the transaction was not requested by you; the service was not provided; what was provided does not match what was booked; or what was provided was defective.

Activity risks

Some of our experiences involve physical effort or take place in remote locations, and knowing and accepting those risks is your responsibility. You must verify that your health condition is fit for the activity, especially if you have heart problems, hypertension, diabetes or another relevant medical condition.

We reserve the right to limit participation in some activities based on age or health condition. We ask you to follow safety instructions, use the equipment provided to you — such as a life jacket on water transfers — and act with care for your safety and that of other participants.

Our responsibility

As the direct operator of La Jorará, we answer for the quality of that stay. As an agency, we answer for the information we publish and for managing your booking, but not for events of force majeure, strikes, weather or public-order conditions, nor for transport services provided by third parties.

We do not answer for goods or services not included in the description of the booked plan, nor for additional personal expenses you choose to take on.

Against the sexual exploitation of children and adolescents

Unique Colombia is committed against the commercial sexual exploitation of children and adolescents (ESCNNA) and adheres to the code of conduct issued by Colombia's Ministry of Commerce, Industry and Tourism under Resolution 3840 of 2009.

Under article 17 of Law 679 of 2001 and Law 1329 of 2009, the sexual exploitation and abuse of minors in Colombia is subject to criminal and administrative sanctions.

Intellectual property

The photos, text and design of the site belong to Unique Colombia or are used with the corresponding authorisation. They may not be copied, reproduced or used for anything other than browsing the site and booking our services, without our prior permission.

Unique Colombia is a registered trademark. Unauthorised use, including reproducing the logo, may lead to the sanctions the law provides.

How we handle your personal data

How we collect, use and protect your data is described in our Personal data policy, which forms part of these Terms and Conditions.

Changes to these terms

We may modify these Terms and Conditions at any time. Changes take effect when published on the site, and the date of the last update appears at the top of this page.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute is submitted to the competent courts of Santa Marta, and proceedings are conducted in Spanish.

This page also exists in English as a courtesy for readers who prefer it. If the two versions differ in any way, the Spanish version governs.
